Pressions exercées par l'employeur pour signer un avenant : elle justifie la prise d'acte du salarié protégé !

L'employeur peut alors y renoncer ou saisir l'inspection du travail en vue d'un licenciement. Mais s'il continue à exercer des pressions sur le salarié, ce dernier est fondé à prendre acte de la rupture de son contrat de travail.
Le salarié protégé : un lanceur d’alerte comme les autres

Cette protection peut se cumuler avec celle dont jouit, le cas échéant, le salarié au titre d’un mandat représentatif ou syndical. Ce qui explique que l’autorité administrative, saisie d’une demande de licenciement, doit s’assurer que le salarié concerné puisse s’en prévaloir, sous le contrôle du juge administratif.
